General Terms and Conditions of Sale

ARTICLE 1 – DEFINITIONS

  • Buyer: Person placing an order for Products on the Site.
  • GTC: General terms and conditions of sale of the Products.
  • Order: Purchase of one or more Products by a Buyer on the Site.
  • Product(s): Items sold on the Site by the Seller, including fashion accessories and home decor.
  • Customer Service: Seller's Customer Service, whose contact details are provided in Article 17 of the GTC.
  • Site: The Seller's online sales website, accessible at https://www.elene-paris.com.
  • Territory: Worldwide.
  • User: Any person visiting the Site.
  • Seller: ELENE company, a simplified joint-stock company with a share capital of three thousand euros, having its registered office at 263 rue Lecourbe - 75015 PARIS, registered with the Paris Trade and Companies Register under number 928 097 088 R.C.S. Paris - intra-community VAT number [number] - contact@elene-paris.com, through its Site.

ARTICLE 2 - SCOPE OF APPLICATION

The GTC apply without restriction or reservation to all sales of Products made by the Seller through its Site to Buyers defined in Article 1 of the GTC. They apply only for the delivery of Products on the Territory.

ARTICLE 3 – PURPOSE

The purpose of the GTC is to inform any Buyer of the conditions and terms under which the Seller sells the Products through the Site and delivers them, and to define the rights and obligations of the Seller and the Buyer in this context. Any Order of Products implies full and complete acceptance by the Buyer of these GTC.

ARTICLE 4 – PRODUCTS

Information on the Products sold through the Site is available with their references on the Site. It is the Buyer's responsibility to check the list of materials composing the Products listed on the product sheet and to inquire in advance of any Order about possible allergies. The Products are offered for sale as long as they are visible on the Site on the day of its consultation by the Buyer and they have an "Add to Cart" button.

In case of unavailability of a Product ordered after placing the Order, Customer Service will contact the Buyer to inform them of this unavailability, the new estimated delivery time, and the Buyer's option to cancel the Order. In case of cancellation of the Order, the Seller will refund its total price as soon as possible and at the latest within fourteen (14) days following the cancellation of the Order.

ARTICLE 5 – PRICES

The sale prices of the Products displayed on the Site are indicated:

  • All taxes included (TTC) for metropolitan France and in euros, taking into account the VAT rate in force in metropolitan France on the day of the Order;
  • All taxes included (TTC) for the European Union and in euros, taking into account the taxes in force in the relevant country;
  • Excluding taxes (HT) outside the European Union and in the local currency;
  • Excluding delivery charges, billed in addition to the Buyer, unless otherwise stated.

Delivery charges are indicated to the Buyer before the validation of their Order. The applicable prices will be those indicated on the Site at the time of the Buyer's Order validation and recalled in the Order confirmation.

ARTICLE 6 – ORDERING METHODS

Any User of the Site can browse the Products without obligation to purchase. It is not mandatory to open a personal customer account to place an Order on the Site. To place an Order, the Buyer can select one or more Product(s) of their choice from the various categories offered and available for sale on the Site on the day of the consultation.

The Buyer can add the selected Product to their cart by clicking on the "Add to Cart" button from the Product sheet. Once the Buyer has finished selecting the Product(s) they wish to purchase, they must click on the "Order" button. The Buyer then obtains an Order summary, mentioning in particular the total price of the Order in euros, including the unit cost of the Product(s) and delivery charges if applicable.

If the Order summary suits them, the Buyer must then enter the following information (or confirm it if it is pre-filled in case of a customer account): their contact details (name, first name, phone, email); their choice of delivery method, the delivery charges varying depending on the delivery method and the delivery location; the delivery address (necessarily located in the Territory defined in Article 1 of the GTC); the billing address if it is different from the delivery address; the selected payment method.

The Buyer guarantees and is responsible for the accuracy and completeness of the information provided. The Buyer can modify their Order and correct any errors at any time before payment of the Order. Unless specific conditions applicable depending on the destination country, payment is made exclusively in euros and is carried out at the Buyer's choice:

  • By credit card (by choosing payment by credit card - CB network, Visa, Eurocard/Mastercard, the Buyer is automatically redirected to the dedicated secure payment site),
  • Or via their PayPal account,
  • Or via their Apple Pay account.

If the payment is accepted, the Buyer will automatically see the Order validation page appear on the Site. In case of payment failure, the Buyer will be redirected to a screen on the Site indicating the payment refusal using the chosen payment method.

Payment is made in full and in one installment at the end of the Order process, unless otherwise stated. The Buyer is debited at the time of Order confirmation by the Seller. The Buyer cannot cancel their Order after its validation and payment.

In case of payment by credit card, the Buyer guarantees the Seller that they are the holder of the credit card used for the Order payment and that the first and last names appearing on the card to be debited are indeed theirs. The Buyer communicates in a secure Internet environment, the number and expiration date on the front of their credit card as well as the visual cryptogram numbers on the back of their credit card. These data are not communicated to the Seller, who only keeps a transaction number.

ARTICLE 7 – PAYMENT TERMS

Payment can be made by credit card, bank transfer, or any other method accepted by the Seller. Invoices are payable within a maximum of ten (10) days from the Order confirmation date. In case of delay in payment of an invoice, the Seller reserves the right to suspend the execution of the Order and to claim a lump sum compensation of forty (40) euros for recovery costs in accordance with Article L.441-6 of the French Commercial Code.

ARTICLE 8 – RESERVATION OF TITLE

The Products remain the property of the Seller until full payment of the Order.

ARTICLE 9 – DELIVERY

The delivery time is provided at the time of the Order and may vary depending on the destination and the availability of the Products. The Seller agrees to deliver the Products within a maximum of thirty (30) days from the date of Order confirmation. The delivery of the Products is made to the address indicated by the Buyer when placing the Order. The Seller is not responsible for any delay in delivery due to unforeseeable and unavoidable circumstances (force majeure).

ARTICLE 10 – RIGHT OF WITHDRAWAL

The Buyer has the right to withdraw from the Order within fourteen (14) days from the delivery of the Products. To exercise the right of withdrawal, the Buyer must notify the Seller of their decision to withdraw by sending an unequivocal statement (by post or email). The Products must be returned in their original packaging, unused and in perfect condition within fourteen (14) days from the notification of the withdrawal. The return costs are the responsibility of the Buyer. The Seller will refund the Buyer for the full amount paid, including delivery costs (except for additional costs arising from the fact that the Buyer has chosen a delivery method other than the less expensive standard delivery method offered by the Seller), within fourteen (14) days from the day on which the Seller receives the returned Products or from the day the Buyer provides proof of return of the Products.

ARTICLE 11 – WARRANTIES

The Products benefit from the legal guarantees of conformity and against hidden defects. In case of non-conformity or hidden defect of the Product, the Buyer can return it and obtain its replacement or refund.

ARTICLE 12 – LIABILITY

The Seller cannot be held liable in case of improper use of the Products by the Buyer or non-compliance with the instructions for use. The Seller is not liable for any indirect damage resulting from the use or purchase of the Products.

ARTICLE 13 – PERSONAL DATA

The personal data collected from the Buyer is processed in accordance with the Seller's privacy policy. The Buyer has the right to access, rectify, and delete their personal data.

ARTICLE 14 – INTELLECTUAL PROPERTY

All elements of the Site, whether visual or audio, including the underlying technology, are protected by copyright, trademark, and patent laws. They are the exclusive property of the Seller. Any use, reproduction, or representation, in whole or in part, of the Site or any of its elements without the express authorization of the Seller is prohibited and constitutes an infringement punishable by law.

ARTICLE 15 – APPLICABLE LAW AND JURISDICTION

The GTC are governed by French law. Any dispute relating to the interpretation, execution, or termination of the GTC will be subject to the exclusive jurisdiction of the courts of Paris, France.

ARTICLE 17 – MISCELLANEOUS

If any provision of the GTC is found to be invalid or unenforceable by a court of competent jurisdiction, such invalidity or unenforceability will not affect the other provisions of the GTC, which will remain in full force.
